(1) A person may bring a proceeding in the District Court for 1 or more of the
following orders—
(a) an order to remedy or restrain the commission of an
offence against this Act (an
"enforcement order" );
(b) an order that a person who has committed an
offence against this Act pay damages to compensate the applicant for injury
suffered by the applicant or loss or damage to the applicant’s property
because of the commission of the offence;
(c) if the person has brought a
proceeding under paragraph (a) and the court has not decided the
proceeding—for an order under section 786(an
"interim enforcement order" );
(2) The person may bring a proceeding under
subsection (1) (a) whether or not any right of the person has been, or may be,
infringed by, or because of, the commission of the offence.
(3) If a person
other than the chief executive brings a proceeding under this section, the
person must, within 5 business days of commencing to bring the proceeding,
give the chief executive notice of the proceeding.
