WATER ACT 2000 - SECT 25

25 Limiting water taken under water licence, permit or allocation

(1) If there is a shortage of water, the chief executive may, by publishing a notice, limit the water that may be--

(a) taken or interfered with under a water licence; or
(b) taken under a water permit; or
(c) taken under a water allocation not managed under a resource operations licence.

(2) The notice may be for any 1 or more of the following--

(a) the times when water may be taken by a licensee or permittee;
(b) the purpose for which water may be taken;
(c) the volume of water, measured or estimated, that may be taken by a licensee, permittee or the holder of a water allocation for a stated purpose.

(3) The notice remains in force for the period stated in the notice or, if no period is stated, until the chief executive publishes another notice withdrawing the first notice.

(4) A person must not take water in contravention of the notice.

Maximum penalty for subsection (4)--500 penalty units.
