(1) This section applies for a permit granted under section 269(1) for a
destruction activity (a
"destruction permit" ) if—
(a) the destruction permit is in force
immediately before the commencement; and
(b) the activity relates to an area
of vegetation less than 0.5ha within a watercourse, lake or spring; and
(c)
there is no development approval for the activity.
(2) From the
commencement—
(a) the activity is taken, until the expiry of the
destruction permit, to be assessable development for which a development
approval, in the form of a development permit, has been granted; and
(b) the
area of vegetation is taken to be the land to which the development approval
is attached; and
(c) the destruction permit has effect, until its expiry, as
if it were the development permit for the destruction activity; and
(d) any
condition of the destruction permit takes effect as if it were a condition of
the development permit.
