109 When application may not be made
(1) An application can not be made for a water licence— (a) for an activity
the applicant is authorised to do under part 3 , division 1 ; or
(b) in
relation to the release of unallocated water.
(2) Subsection (1) (b) does not
apply to an application that is part of a process prescribed under section 40
(2) .
