1013B Non-payment of fees or charges
(1) Subsection (2) applies if all or part of a fee or charge payable to the
chief executive under a regulation made under this Act remains unpaid for 20
business days after the day stated in the regulation for payment of the fee or
charge.
(2) The chief executive may give the person who is liable to pay the
fee or charge a written notice—
(a) stating the period to which the fee or
charge relates; and
(b) stating the amount, including any late fee, owing at
the date of the notice; and
(c) requiring the person—
(i) to pay the amount
owing; or
(ii) to make arrangements, satisfactory to the chief executive, for
payment of the amount owing; and
(d) prohibiting the taking of water under
the authority under this Act to take water to which the fee or charge relates
until payment or arrangements are made under paragraph (c) .
(3) However—
(a) an authority mentioned in subsection (2) (d) does not include an authority
under chapter 2 , part 3 , division 1 ; and
(b) subsection (2) (d) does not
apply if the holder of the authority is a service provider; and
(c) a
prohibition under subsection (2) (d) must not apply to taking the minimum
volume of water, that may be stated in the notice, necessary for stock or
domestic purposes.
(4) A person must not take water in contravention of the
notice.
Penalty—
Maximum penalty for subsection (4) —1,665 penalty
units.
