TRANSPORT OPERATIONS (ROAD USE MANAGEMENT) ACT 1995 - SECT 79AA
Provisions applying to supervisor of a learner
(1) This section applies to a person who is the supervisor of a learner while
the learner is driving a motor vehicle under the direction of the supervisor .
(2) The supervisor is in charge of the motor vehicle for the purposes of—
(a) the relevant provisions ; and (b) other provisions of this Act applying in
relation to any charge, proceedings, conviction or sentence for an offence
against a relevant provision. Examples for subsection (2)(a)— 1 If a
learner is driving a car under the direction of a supervisor , the supervisor
is in charge of the car and must not be over the general alcohol limit . 2 If
a learner is driving a truck or bus under the direction of a supervisor , the
supervisor of the learner is in charge of the truck or bus and must not be
over the no alcohol limit . (3) Subsection (2) has no effect on the
application of the relevant provisions , or any other provisions of this Act,
to the learner . (4) In this section—
"learner" means— (a) the holder of a licence that, under a regulation,
authorises the holder to learn to drive a motor vehicle ; or (b) the holder of
a licence granted outside Queensland that corresponds to a licence mentioned
in paragraph (a) .
"relevant provisions" means sections 79 and 80 .
"supervisor" , of a learner — (a) means a person who— (i) under a
regulation, is a person with whom a learner is authorised to drive under
direction; or (ii) purports to be a person mentioned in subparagraph (i) ;
but (b) does not include a person accredited as a driver trainer under a
regulation while the person is acting in the person’s professional capacity
as a driver trainer.
