Entitlement of satisfactorily performing existing operator under a service contract
62AC Entitlement of satisfactorily performing existing operator under a
service contract
(1) This section applies if—
(a) an operator is providing a school service
for an area or route under a prescribed school service contract; and
(b) the
chief executive proposes, at the end of the contract’s term, to enter into a
prescribed school service contract for the same, or substantially the same,
area or route; and
(c) no notice has been given to the operator under
subsection (4) for the contract.
(2) The chief executive must give the
operator the first opportunity to offer for the contract by giving the
operator a notice under subsection (3) .
(3) The notice must invite the
operator to make an offer, in a stated way, for the contract within a stated
period of not less than 60 days.
(4) The chief executive may, for this
section, decide that a contract holder’s performance under the contract has
been unsatisfactory and give the holder written notice of the decision and the
reasons for it.
(5) This section does not apply in relation to a contract—
(a) that is an emergency service contract; or
(b) that states that this
section does not apply to it.
