(c) a provision of a regulation
prescribed by regulation to be a provision to which this section applies.
(2)
A person has committed an offence if the person—
(a) has been convicted of
the offence; or
(b) has been served with an infringement notice for the
offence and the infringement notice has been dealt with under the
State Penalties Enforcement Act 1999.
(3) For subsection (2) (b) , an
infringement notice for an offence served on a person has been dealt with
under the State Penalties Enforcement Act 1999if 1 of the following has
happened under that Act—
(a) the fine for the infringement notice has been
paid in full;
(b) the person has applied for approval to pay the fine for the
infringement notice by instalments;
(c) an enforcement order has been made
against the person for the offence under section 38of that Act.
