12 Powers
(1) A distributor-retailer has all the powers of an individual and may, for
example—
(a) enter into contracts; and
(b) acquire, hold, dispose of and
deal with property; and
(c) employ staff; and
(d) appoint agents and
attorneys; and
(e) engage consultants; and
(f) fix charges and other terms
for services and other facilities it supplies; and
(g) do anything else
necessary or convenient to be done for its functions.
(2) Without limiting
subsection (1) , a distributor-retailer has the powers given to it under an
Act.
(3) Despite subsections (1) and (2) , a distributor-retailer’s powers
are subject to any limitations under the Act s mentioned in part 2 .
(4)
However, an exercise of a power in contravention of a limitation or
restriction under an Act does not invalidate or otherwise affect the exercise
of the power.
