76S Entering into agreement
(1) The Coordinator-General may, with the approval of the Minister, enter into
an agreement (a
"voluntary environmental agreement" ) with an applicant for a prescribed
decision, or the applicant and another person, about—
(a) preventing,
controlling or mitigating detrimental environmental effects of a prescribed
project; or
(b) conserving, maintaining, rehabilitating or enhancing aspects
of the environment.
(2) However, if the rights of any of the following
persons will be materially affected by the agreement, the Coordinator-General
must not enter into it without that person’s written consent—
(a) if the
applicant is not the registered owner of land to which the agreement
relates—the registered owner of the land;
(b) if land to which the
agreement relates is subject to a lease or other interest—the lessee or
interest holder.
