(2) The person must not, in relation
to the operation of a retirement village scheme, engage in conduct that is
misleading or deceptive or is likely to mislead or deceive.
Example of conduct
that is misleading or deceptive or is likely to mislead or deceive—
Giving
false or misleading information (orally or in writing) to—
(a) the chief
executive; or
(b) a resident or prospective resident.
Penalty—
Maximum penalty—200 penalty units.
(3) In this section—
"representative" , of a scheme operator, means—
(a) an employee or agent of
the scheme operator; and
(b) if the scheme operator is a corporation—an
executive officer of the scheme operator.
