(1) The parties to a retirement village dispute may refer the dispute to a
mediation process under this part only if the parties have attempted to
resolve the dispute under this section.
(2) A party to the dispute (the
"first party" ) must give the other party to the dispute (the
"second party" ) written notice—
(a) stating the matters in dispute; and
(b) nominating a day, no earlier than 14 days after the notice is given, (the
"nominated day" ) for the parties to meet within the village to attempt to
resolve the dispute.
(3) The second party must give the first party a written
response to the notice within 7 days after receiving the notice.
(4) On the
nominated day, or another day within 7 days after the nominated day and agreed
by the parties, the parties must meet in the retirement village and attempt to
resolve the dispute.
