Residents may make, change or revoke by-laws
130 Residents may make, change or revoke by-laws
(1) The residents of a retirement village may, by special resolution at a
residents meeting and with the agreement of the scheme operator, make, change
or revoke by-laws for the village.
(2) The scheme operator’s agreement must
not be unreasonably withheld.
(3) A by-law may be made about the
non-exclusive use and enjoyment of the village.
(4) If there is an
inconsistency between a by-law and a provision of a residence contract for the
village, the provision prevails to the extent of the inconsistency.
(5)
Subsection (3) does not limit the residents’ power under another law to
make, change or revoke by-laws.
