Secrecy of voting84 Secrecy of voting
A person must not—
(a) unfold a ballot paper that has been marked and folded by an elector under this Act, unless ordered by a court or authorised under this Act to do so; or
(b) if the person is a member of the commission’s staff performing duties at a polling place for a referendum—(i) ascertain or discover how an elector has voted at the referendum, unless the person is authorised to do so under this Act; or(ii) disclose any information about how an elector has voted at a referendum, unless the person is authorised to do so under this Act or ordered by a court to do so.
Penalty—Maximum penalty—20 penalty units or 6 months imprisonment.
