238 Protection from civil liability
(1) An official is not civilly liable for an act done, or omission made,
honestly and without negligence under this Act or an enabling Act.
(2) If
subsection (1) prevents civil liability attaching to an official, the
liability attaches instead to the State.
(3) This section is subject to
section 237 to the extent it relates to the civil liability of the principal
registrar or a registrar.
(4) In this section—
"official" means— (a) the chief executive; or
(b) the principal registrar,
a registrar or a registry staff member; or
(c) a person acting under the
authority or direction of the tribunal or chief executive; or
(d) a
Magistrates Court staff member performing a function of the principal
registrar delegated to the member under section 210 (2) .
