Constitution of appeal tribunal
166 Constitution of appeal tribunal
(1) The tribunal is to be constituted for an appeal or an application for
leave to appeal, under chapter 2 , part 8 , division 1 , by 1, 2 or 3 judicial
members.
(2) If the president considers it appropriate for a particular
appeal or application for leave to appeal, the president may choose 1, 2 or 3
suitably qualified members to constitute the tribunal for the appeal or
application, whether or not in combination with a judicial member.
(3)
Subsection (2) does not apply in relation to an appeal or an application for
leave to appeal if the appeal or application relates to a decision of the
tribunal as constituted by a magistrate.
