Effect of appeal on decision
152 Effect of appeal on decision
(1) The start of an appeal, under this division or an enabling Act, against a
decision of the tribunal does not affect the operation of the decision or
prevent the taking of action to implement the decision.
(2) However, the
Court of Appeal, or the tribunal as constituted when the decision was made,
may make an order staying the operation of the decision until the appeal is
finally decided.
(3) An order made by the Court of Appeal may be subject to
the conditions the court considers appropriate.
Note—
Under section 114,
an order made by the tribunal under this section may also be subject to
conditions.
(4) The Court of Appeal or the tribunal may make an order under
subsection (2) on the application of the appellant or on its own initiative.
(5) If the tribunal makes an order under subsection (2) , the Court of Appeal
may amend or revoke the order as if the order had been made by the Court of
Appeal.
