Meaning of relevant offence

323 Meaning of relevant offence

(1) A
"relevant offence" is an offence against a law of this jurisdiction that is—
(a) a seven year imprisonment offence; or
(b) an indictable offence included in schedule 2 .
(2) However, to the extent any provision of this Act applies to matters mentioned in subsection (3) , a
"relevant offence" is an offence against a law of this jurisdiction that is—
(a) a three year imprisonment offence; or
(b) an indictable offence included in schedule 2 .
(3) For subsection (2) , the matters are—
(a) an application for a surveillance device warrant—
(i) that authorises the use of a tracking device only; and
(ii) does not authorise covert entry to a building by a person installing it; and
(b) a surveillance device warrant mentioned in paragraph (a) .
