Meaning of separation agreement
(1) A
"separation agreement" is an agreement— (a) made by de facto partners— (i)
in contemplation of ending their de facto relationship; or
(ii) after their
de facto relationship has ended; and
(b) dealing with all or some of the de
facto partners’ financial matters.
(2) A
"separation agreement" includes a separation agreement varying a cohabitation
agreement or separation agreement.
(3) It does not matter whether— (a) a
separation agreement is made before or after the commencement of this section;
or
(b) there are other parties to a separation agreement; or
(c) a
separation agreement deals with other matters.
