195C Confidentiality
(1) A person who is a member of a community justice group must not—
(a)
record or use information the person, or another person who is a member of the
community justice group, gains through performing a function under this Act,
or intentionally disclose it to anyone, other than under subsection (2) ; or
(b) recklessly disclose the information to anyone.
Penalty—
Maximum
penalty—100 penalty units or 2 years imprisonment.
(2) A person who is a
member of a community justice group may—
(a) record, use or disclose the
information if the recording, use or disclosure—
(i) is done as part of
making submissions to the court under section 9(2) (p) ; or
(ii) is
otherwise required or permitted by law; or
(b) disclose the information to
another member of the community justice group.
(3) In this section—
"disclose" information to someone else means—
(a) orally disclose the
information to the other person; or
(b) produce to the other person, or give
the other person access to, a document containing the information; or
(c)
disclose the information to the other person in another way.
