Extension of term of declaration
93 Extension of term of declaration
(1) If—
(a) a declaration of a
potential commercial area is in force for the area of an authority to
prospect; and
(b) under the Mineral Resources Act , chapter 8 , part 2 or 3 ,
a coal or oil shale mining lease has been granted over the area;
the Minister
may, on the application of the authority to prospect holder, extend the term
of the declaration for a period that ends no later than 2 years after the
mining lease, or any renewal of the mining lease, ends.
(2) The application
must be accompanied by the fee prescribed under a regulation.
(3) On refusal
of the application, the applicant must be given an information notice about
the decision to refuse.
