Evidence of planning instruments or designations
53 Evidence of planning instruments or designations
(1) A certified copy of
a planning instrument or designation notice is evidence of the content of the
instrument or notice.
(2) The P&E Court must take judicial notice of a
certified copy of a planning instrument or designation notice.
(3) A copy of
the gazette or newspaper containing a notice about the making of a planning
instrument or designation is evidence of the matters stated in the notice.
(4) In this section—
"certified copy" , of a document, see the Planning Act , schedule 2 .
"designation" see the Planning Act , section 35 (1) .
"designation notice" means a notice under the Planning Act , section 38 (2)
(b) or (c) .
