59 What this division is about
(1) This division is about deciding properly made applications, including
variation requests.
(2) An assessment manager must follow the development
assessment process for the application even if a referral agency’s response
directs the assessment manager to refuse the application.
(3) Subject to
section 62, the assessment manager’s decision must be based on the
assessment of the development carried out by the assessment manager.
