82 Preservation of rights if public service officer seconded
(1) A public service officer seconded under section 77—
(a) is entitled to
the person’s existing and accruing rights as if employment as an officer of
the ombudsman were a continuation of employment as a public service officer;
and
(b) may apply for positions, and be employed, in the public service as if
the person were a public service officer.
(2) On ending the secondment, the
person’s employment on secondment as an officer of the ombudsman is taken to
be employment of the same nature in the public service for working out the
person’s rights as a public service officer.
(3) If the secondment ended
for a reason other than misconduct, the person is entitled to be employed as a
public service officer.
(4) The person is entitled to be employed on the
same, or a higher, classification level and remuneration that the Public
Sector Commissioner under the Public Sector Act 2022or another entity
prescribed under a regulation considers the person would have attained in the
ordinary course of progression if the person had not been seconded.
