46 Disclosure of certain matters not required
(1) This Act does not require or authorise a person—
(a) to give any
information or answer any question relating to proceedings of Cabinet or a
committee of Cabinet; or
(b) to produce or inspect a document to the extent
it relates to proceedings mentioned in paragraph (a) .
(2) For subsection (1)
, a certificate issued by the chief executive of a department administered by
the Premier, with the Premier’s approval, certifying that any information or
question, or any document or part of a document, relates to any proceedings
mentioned in subsection (1) is conclusive of the fact so certified.
(3) The
ombudsman must not require—
(a) any information or answer to be given; or
(b) the production of any document or thing;
if the Attorney-General
certifies, in writing, that the giving of the information, or the answering of
the question, or the production of the document or thing might prejudice the
security of the State or the investigation or detection of offences.
