(1) An amount of conservation value payable under this Act is a debt due to
the State and may be recovered in a court having jurisdiction for the recovery
of debts up to the amount concerned.
(2) A proceeding may be instituted
against a person for the recovery of an amount of conservation value payable
under this Act whether or not—
(a) a prosecution has been instituted against
the person for an offence in relation to the non-payment; or
(b) the person
has been convicted of an offence in relation to the non-payment.
