173N Proceeding brought in representative capacity
(1) A proceeding under this division may be brought by a person on behalf of
an entity with the entity’s consent.
(2) The person who brings the
proceeding is a party to the proceeding, despite the proceeding being brought
on behalf of another entity.
(3) The entity on whose behalf the proceeding is
brought is not a party to the proceeding.
(4) If the entity on whose behalf
the proceeding is brought is an unincorporated body, the body’s committee or
other controlling or governing body must give the consent.
(5) The entity on
whose behalf the proceeding is brought may contribute to, or pay, the legal
costs incurred by the person bringing the proceeding.
