Mining lease may be specified it is not renewable
285 Mining lease may be specified it is not renewable
(1) Subsection (2) applies if the Minister is satisfied the land the subject
of an application for grant or renewal of a mining lease is, or will be,
required for some purpose other than mining.
(2) The Minister may grant the
lease or renewal subject to a condition that the holder is not entitled to
have the mining lease renewed or further renewed.
(3) If a mining lease is
granted or renewed subject to a condition mentioned in subsection (2) —
(a)
the Minister must give written notice of the reasons for the decision; and
(b) the chief executive must record in the register the details of the
condition.
