(1) Subject to this Act, the commissioner must consider an application for a
cultural recognition order in accordance with any guidelines made by the
commissioner under section 108.
(2) Also, the commissioner, in considering
the application—
(a) must act in a way that is fair and reasonable; and
(b)
must maintain confidentiality; and
(c) must comply with natural justice; and
(d) may have regard to any matter the commissioner considers relevant to the
application, including any previous applications made in relation to the
person the subject of the application; and
(e) may make inquiries the
commissioner considers appropriate.
