Preservation of rights if public service officer appointed or engaged
593 Preservation of rights if public service officer appointed or engaged
(1) A public service officer appointed to an office (whether under this part
or under the Legal Profession Act 2004, chapter 6 , part 1 ) is entitled or
continues to be entitled to retain all existing and accruing rights as if
service in that office were a continuation of service as a public service
officer.
(2) If the person stops holding that office for a reason other than
misconduct, the person—
(a) is entitled to be employed as a public service
officer; and
(b) is to be employed on the classification level and
remuneration that the Public Sector Commissioner under the
Public Sector Act 2022or another entity prescribed under a regulation
considers the person would have attained in the ordinary course of progression
if the person had continued in employment as a public service officer.
