Appointment of manager
505 Appointment of manager
(1) This section applies if the law society decides to appoint a manager for a
law practice.
(2) The law society must, in a law society approved form,
appoint a person as the manager who is an Australian legal practitioner
holding an unrestricted practising certificate.
(3) The manager may, but need
not, be an employee of the law society.
(4) The instrument of appointment
must—
(a) identify the law practice and the manager; and
(b) indicate that
the external intervention is by way of appointment of a manager; and
(c)
state the term of the appointment; and
(d) state any conditions imposed by
the law society when the appointment is made; and
(e) state the fees payable
by way of remuneration to the manager for carrying out his or her duties for
the external intervention; and
(f) provide for the legal costs and expenses
that may be incurred by the manager for the external intervention; and
(g)
include any other information required under a regulation to be included in
the instrument of appointment.
(5) The instrument of appointment may state
any reporting requirements to be observed by the manager.
