JUSTICES OF THE PEACE AND COMMISSIONERS FOR DECLARATIONS ACT 1991 - SECT 16

16 Qualifications of office

(1) A person is not qualified to be appointed under this Act as a justice of the peace or a commissioner for declarations unless--

(a) the Governor in Council considers the person to be fit and proper; and
(b) the person is of or above the age of 18 years; and
(c) if the Minister has approved a training course that the person is required to complete before being so appointed--the person has completed the course; and
(d) the person is an Australian citizen.

(2) Subsection (1)(c) does not apply to the appointment of an Australian lawyer.

(3) Subsection (1)(d) does not apply to a person who has continued to hold office as a justice of the peace because of section 41(a).
