(1) This section applies if a person owes an amount to the chief executive
arising out of, or relating to, the chief executive’s provision of a
housing service.
Examples of amounts that may be owed to the chief
executive—
• a rental payment
• an instalment due under a loan
agreement
• an amount of compensation for damage caused to a rental
property
(2) The chief executive may waive, entirely or partly, payment of
the amount if the chief executive is satisfied the waiver is appropriate in
all the circumstances.
(3) The chief executive may waive payment
unconditionally or on the conditions the chief executive considers
appropriate.
Example—
The chief executive may waive payment of part of an
amount owed by a person on the condition that the person enters into a written
agreement about repayment of the rest of the amount.
(4) In making a
decision under this section about waiving payment of an amount owed by a
person, the chief executive must have regard to all the relevant circumstances
of which the chief executive is aware, including, for example—
(a) the size
of the amount owed; and
(b) why the person owes the amount; and
(c) whether
payment of the amount would cause the person financial hardship; and
(d) the
person’s likely ability to repay the amount in the future; and
(e) any
special circumstances relevant to whether it would be fair to enforce payment
of the amount.
