Queensland Consolidated Acts Queensland Consolidated Acts(1) Notwithstanding the Criminal Code, sections 7 and 23 where any person commits an offence against this division in respect of the lighting of a fire as an agent or employee, the principal or employer of that person is taken to have committed the offence and may be prosecuted and punished for the offence unless it is proved that the agent or employee was acting contrary to instructions and that the principal or employer could not have prevented the commission of the offence by exercising reasonable supervision.
(2) Subsection (1) applies without prejudicing any liability imposed under this division upon the person by whom an offence is actually committed.
