FINANCIAL ACCOUNTABILITY ACT 2009 - SECT 9
Meaning of statutory body
(1) A
"statutory body" is an entity that— (a) is established under an Act; and
(b) has control of funds; and
(c) includes, or whose governing body includes,
at least 1 member— (i) who is appointed under an Act by the Governor in
Council or a Minister; or
(ii) whose appointment is approved by the Governor
in Council or a Minister.
(2) However, an entity is not a statutory body for
this Act if it is— (a) a department; or
(b) a part of a department as
mentioned in section 8 (3) ; or
(c) a local government; or
(d) an entity
prescribed under another Act not to be a statutory body for this Act.
(3) If
an Act that establishes an entity states that the entity is a statutory body
for this Act, the entity— (a) is a statutory body for this Act; and
(b) is
not part of a department for this Act despite section 8 (3) .
