70C Continuance of particular authorities
(1) This section applies only if the authority is of a type prescribed by
regulation.
(2) If, immediately before the individual’s death, the
individual was the only holder of the authority—
(a) the authority continues
in force, subject to this Act; and
(b) the individual’s personal
representative becomes the holder of the authority.
(3) If, immediately
before the death, there was more than 1 holder of the authority—
(a) the
individual’s personal representative becomes a holder of the authority; and
(b) the other holders of the authority continue to be holders of the
authority, unaffected by the individual’s death.
(4) A personal
representative who, under this section, becomes a holder takes the entitlement
the individual had under the authority immediately before the death.
