FISHERIES ACT 1994 - SECT 52
Things authorised by authorities
52 Things authorised by authorities
(1) An authority authorises the holder of the authority to do the things
permitted under a regulation or declaration or stated in the authority.
(2) A
regulation or declaration, or the authority itself, may also authorise other
persons to do all or any of the things authorised by it. Example of someone
else authorised by an authority— a person who is a member of the crew of a
boat owned by the holder
(3) However, an authority does not authorise the
holder or anyone else (other than an inspector) to enter, or remain on,
someone else’s land.
(4) Also, a resource allocation authority does not
confer on the holder— (a) any right of ownership or tenure over the land,
waters or resources mentioned in the authority; or
(b) the right to carry out
the development mentioned in the authority, unless the development is also
authorised under the Planning Act . Note— See also section 76T and the
Planning Act , section 163 .
