Inspector may dispose of fisheries resources taken unlawfully
159 Inspector may dispose of fisheries resources taken unlawfully
(1) This section applies if fisheries resources are seized under this Act and
an inspector believes, on reasonable grounds, that the fisheries resources
have been taken unlawfully.
(2) If the fisheries resources are alive, the
inspector may immediately return them to the wild or, if appropriate, the
place from which they were taken.
(3) If the fisheries resources are dead and
the inspector believes, on reasonable grounds, that they are putrid, unfit for
sale, of no value or of insufficient value to justify their sale, the
inspector may immediately dispose of the fisheries resources in a way decided
by the inspector.
