40B Amending conditions of permit
(1) The chief executive may amend or omit a condition of a commercial activity
permit, when the permit is renewed—
(a) at the request of the permit holder;
or
(b) on the chief executive’s own initiative.
(2) However, the chief
executive may amend a condition, subject to section 40C(3) (b) , only if the
chief executive reasonably considers the amendment is necessary—
(a) to
provide for the safety of people or property; or
(b) to provide for the
proper management of the area to which the permit relates; or
(c) because the
permit holder did not comply with a condition of the existing permit; or
(d)
to conserve or protect forest products or other cultural or natural resources
of the area to which the permit relates.
