420 Special education for people enrolled at non-State school or below
compulsory school age
(1) The Minister may provide, or assist in the
provision of, special education to a person with a disability who is enrolled
at a non-State school.
(2) Also, subject to the agreement of a parent of a
person with a disability who is below compulsory school age, the Minister may
provide, or assist in the provision of, special education to the person with a
disability.
(3) Subsection (4) applies to a person with a disability who—
(a) under subsection (2) , is being provided with special education; and
(b)
is not enrolled in the preparatory year at the school at which the special
education is being provided.
(4) The person is not, for this Act—
(a) a
student of the school; or
(b) enrolled at the school.
(5) In this section—
"person with a disability" means a person who is decided, under a policy
mentioned in section 420A(1) , to be a person with a disability.
