373 Confidentiality of financial data
(1) This section applies to the
following persons— (a) a person who is, or was, the Minister;
(b) another
person who is, or was, involved in the administration of this part, including,
for example, as a public service employee.
(2) The person must not disclose
protected information to anyone else. Penalty— Maximum penalty—50
penalty units.
(3) Subsection (2) does not apply if— (a) the information
is disclosed— (i) in the performance of functions under this part; or
(ii)
under section 425A ; or
(iii) with the written consent of the governing body
of the school to which the information relates; or
(b) the information is
otherwise publicly available; or
(c) the disclosure of the information is
permitted or required under an Act or other law.
(4) In this section—
"protected information" means information disclosed to, or obtained by, a
person to whom this section applies under section 370 or 371 .
