(1) For this division, a
"person with a disability" is a person who is decided, under a policy approved
under subsection (2) , to be unlikely to attain the levels of development of
which the person is capable unless the person receives special education.
(2)
The Minister must approve a policy about the criteria to be considered in
deciding whether a person is a person with a disability.
(3) The chief
executive must keep a copy of a policy approved under subsection (2) available
for inspection and permit a person—
(a) to inspect the policy without fee;
and
(b) to take extracts from the policy without fee.
(4) For subsection (3)
—
(a) a copy of the policy—
(i) must be kept at the head office of the
department; and
(ii) may be kept at any other place the chief executive
considers appropriate; and
(b) the copy kept under paragraph (a) must be
available for inspection during office hours on business days for the office
or place.
(5) Also, the chief executive must supply a copy of a policy
approved under subsection (2) , or a part of the policy, to a person on
request, without fee.
(6) In addition, the chief executive must keep a copy
of a policy approved under subsection (2) on the department’s website.
