126 Restriction on who may be a member of executive committee
(1) Subsection (2) applies only at the time of election of the office holders
of an association under section 123.
(2) The number of
relevant staff members of the State instructional institution for which the
association is formed who may be members of the executive committee of the
association must not be more than one-third of the number of members of the
executive committee.
(3) Subsection (2) does not apply to the association
if—
(a) the chief executive reasonably believes that compliance with the
requirement mentioned in that subsection will prevent all the positions of the
executive committee being filled; and
(b) the chief executive notifies the
association that it is not required to comply with that subsection.
(4) In
this section—
"relevant staff member" means—
(a) for a State school—a staff member of
the school who is not a parent of a child attending the school; or
(b) for an
educational institution established under section 14—a staff member of the
institution.
