(2) If the application is for a code compliant
authority, the relevant transitional authority becomes a code compliant
authority under chapter 5.
(3) If the application is for a non-code compliant
authority for a level 2 mining project and no additional conditions are
requested in the application, the relevant transitional authority becomes a
non-code compliant authority for a level 2 mining project.
