ENVIRONMENTAL PROTECTION ACT 1994 - SECT 350

Program notice

350 Program notice

(1) A person may give the administering authority a notice (the
"program notice" ) about an act or omission (the
"relevant event" ) that—
(a) has caused or threatened environmental harm in the carrying out of an activity by the person; and
(b) is lawful apart from this Act.
(2) The notice must—
(a) be in the approved form; and
(b) give full details of the relevant event; and
(c) declare the person’s intention to apply to the authority for the issue of a transitional environmental program for the activity; and
(d) state the other information prescribed by regulation.
(3) The person may submit with the notice any report, or the results of any analysis, monitoring program, test or examination, carried out by or for the person for the relevant event.
