337 When decision must be made—generally
(1) The administering authority must decide whether to approve an application
for the issue of a transitional environmental program within 20 business days
after—
(a) if public notice is required under section 335—the day stated
in the notice as the day by which submissions may be made to the administering
authority; or
(b) if public notice is not required and further information is
not requested under section 334A(1) —the day the application is received by
the administering authority; or
(c) if public notice is not required and
further information is requested under section 334A(1) —the day a response
to the request for further information is received.
(2) The administering
authority may extend the period mentioned in subsection (1) for making the
decision if, before the extension starts, it gives an information notice about
the decision to extend to—
(a) the person or public authority that made the
application; and
(b) any submitters.
(3) If public notice is required to be
given of the application, the administering authority must be satisfied public
notice has been properly given before making a decision.
