(1) The administering authority must, within 10 business days after the
proposed action decision is made, give the environmental authority holder an
information notice about the decision.
(2) If the proposed action decision
relates to an environmental authority for resource activities, the
administering authority must also give written notice of the decision to the
chief executive administering the resource legislation.
(3) The decision
takes effect on the later of the following—
(a) the day the notice is given
to the holder;
(b) a later day of effect stated in the notice.
(4) However,
if the decision was to cancel, suspend or extend the suspension of the
environmental authority because of the conviction of the holder for an
offence, the cancellation, suspension or extended period of suspension—
(a)
does not take effect until—
(i) the period to appeal against the conviction
ends; and
(ii) if the appeal is made against the conviction—the appeal is
finally decided or is otherwise ended; and
(b) has no effect if the
conviction is quashed on appeal.
