Advice from relevant resource legislation chief executive about surrender application
267 Advice from relevant resource legislation chief executive about surrender
application
(1) The administering authority may, before it makes a decision to refuse a
surrender application for an environmental authority for a mining activity,
seek advice from the chief executive of the department in which the
Mineral Resources Actis administered.
(2) Also, the administering authority
may, before it decides a surrender application for an environmental authority
for a resource activity, seek advice from the chief executive administering
the relevant resource legislation about the post-surrender management report
for land the subject of the application.
(3) The advice may be sought in the
way the administering authority considers appropriate.
(4) If the advice is
given, it must be given within the period required under section 266(2) for
the administering authority to make the decision.
