(a) an application for an authority was made
under an existing Act, but not dealt with, before the commencement; and
(b)
that Act allowed for an offset condition to be imposed on the authority; and
(c) the administering agency is deciding whether to impose on the authority a
condition in relation to an environmental offset.
(2) The administering
agency may, at the request of or with the agreement of the applicant, consider
all or part of the environmental offsets policy under this Act instead of all
or part of any policy about environmental offsets (however described) under
the existing Act.
