(1) This section applies to a person who does an act or makes an omission that
is an offence both—
(a) under this part; and
(b) under a law of a
participating State.
(2) The person must not be prosecuted or punished under
this part for the offence if the person has been prosecuted or punished under
the law of the participating State for the offence.
